Gibralter

What happens when the germans take gibralter and then leave prior to US entry - does spain sieze it like if the brits abandon?

So I've eliminated the Gibralter garrison, the US has not entered the war, yet spain isn't seizing it. Is it possible that the presence of a sub in port might negate this affect?
