Clarification on Flak combat rules?

So, I gather that Flak units do not operate as elite units ( though they are listed as elite in the battle orders and they have elite insignia on their icons... A little confusing perhaps ) and that they have no combat value when attacking (perhaps they should not be given firing animations when this happens though - that would be a lot clearer)

But one thing I was wondering : what counts as "attacking" here ?
Certainly, moving the Flak with other units into an enemy controlled space= attacking.
But what if the space where the Flak is is still enemy controlled and the enemy counter attacks in that space ?
Is the Flak defending or attacking (I.e. Still in enemy territory) then?

In the example you pose (flak already in a space and then new friendly units enter and combat ensues), that counts as an "attack" because you initiated combat on your impulse. So the flak does not fire.

Regarding whether it functions as elite, I had this same problem where half of the force being "elite" didn't necessarily generate the -10% to hit reduction if the difference between half and less than half was the flak. I actually think this is a bug but I have been struggling to recreate it. You should submit a bug report (using the Feedback button) if you see it again.

Thanks SpaceRumsfeld! That answers the flak attack/defend question for me - would be good if the game didn't give the flak the firing animation when it can't attack though!

Re: the elite question, I hadn't come across a problem with hit calculations ( I just haven't noticed), but that's a good point. I was just confused about the Flak units elite/nonelite status. Rule section 10.6 in the app states flatly that there are no elite Flak units in the game. yet the flak units are listed as elite in orders of battle and have special elite badgses on their icons

SpaceRumsfeld is right that you are the attacker in any combat you start, and you are the defender in any combat your opponent starts.

But only elite infantry, elite mech infantry and elite recon count towards the "-10% Elite Infantry/Recon >= Half of Defender Strength" bonus. So, yes, because Flak doesn't attack, their elite status is doesn't have an effect on the game.
